Until recently, Florida’s workers’ compensation laws made it extremely difficult for first responders to obtain benefits for psychological injuries unless a physical injury accompanied those injuries.
Fortunately, in 2018, Florida lawmakers expanded protections through Section 112.1815 of the Florida Statutes, allowing first responders to receive workers’ compensation for PTSD and mental injuries even without a physical wound, if the condition results from a qualifying traumatic event on the job.
Examples of qualifying incidents may include witnessing a death, responding to mass casualty events, or seeing the aftermath of severe violence or accidents. To qualify, a licensed mental health professional must diagnose the PTSD as directly work-related. While this law was a significant step forward, insurance companies often still dispute these claims.
Workers’ Compensation Benefits for First Responders
Under Florida law, injured first responders may be entitled to a range of benefits, including:
- Medical treatment for physical or psychological injuries;
- Wage replacement benefits while unable to work;
- Disability benefits for permanent or long-term impairments; and
- Death benefits for surviving family members of those who lose their lives in the line of duty.
